Terms of Use

1. Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of www.jindhan.com and related applications (the “Platform”), operated by Big Mart (“Jindhan”, “we”, “us”, or “our”). By accessing or using the Platform — including by arriving through a link shared by one of our referral partners — you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Platform.

2. Description of Service

Jindhan operates a loan referral and comparison platform. We are not a bank, non-banking financial company (NBFC), or lender. We do not ourselves sanction, disburse, or service any loan. Instead, we collect your details and connect you with third-party banks and NBFCs (“Lending Partners”) who may, at their sole discretion, offer you a personal or business loan based on their own independent credit assessment and eligibility criteria.

Any loan offer shown on the Platform is indicative only. Final terms — including the loan amount, interest rate, tenure, fees, and approval itself — are determined solely by the relevant Lending Partner and are subject to their verification, documentation, and internal policies. Jindhan does not guarantee that any offer will be extended, or that displayed terms will be the final terms.

3. Eligibility

You may use the Platform only if you are at least 18 years old, a resident of India, and legally capable of entering into a binding loan agreement. By using the Platform, you confirm that you meet these requirements.

4. Your Application and Verification

• When you apply directly on the Platform, we verify your mobile number using a One-Time Password (OTP) before creating or resuming your application.
• If you arrive through a link shared by a Referral Partner, that link may let you skip mobile number and OTP verification, because the Referral Partner has already verified your identity and mobile number and transmitted your details to us on that basis. By proceeding through such a link, you confirm that the details transmitted on your behalf are accurate and that you authorize their use to generate loan offers for you.
• A resume link generated for your application is personal to you, single-use where indicated, and should not be shared with anyone else. You are responsible for keeping any link or access code confidential.
• If the same mobile number or PAN is submitted to us from more than one source, we may reject the newer submission and flag it on your existing application; only your original, first application will be progressed.

5. Accuracy of Information

You agree to provide true, accurate, and complete information when using the Platform, and to promptly update it if it changes. You are solely responsible for the consequences of providing inaccurate, outdated, or fraudulent information, including rejection of your application by a Lending Partner.

6. No Fees for Using the Platform

Jindhan does not charge you any fee to submit an application or receive indicative offers through the Platform. If you proceed with a Lending Partner, that Lending Partner’s own fees, charges, and terms and conditions will apply, and you should review them independently before accepting any offer.

7. Referral and Partner Arrangements

Jindhan may receive a referral or commission fee from Lending Partners or pay a referral fee to Referral Partners in connection with successful applications. This does not affect the amount you pay under any loan you take up, and does not influence the accuracy of the information we transmit about you.

8. Intellectual Property

The Platform, including its design, text, graphics, logos, and underlying software, is owned by or licensed to Jindhan and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our prior written consent.

9. Prohibited Conduct

You agree not to:

• Provide false, misleading, or another person’s information without authorization
• Attempt to bypass, probe, or interfere with the Platform’s security, authentication, or verification mechanisms
• Access or attempt to access another user’s application or data
• Use automated means (bots, scripts) to interact with the Platform except as expressly permitted (for example, through our published Partner Lead API under a separate agreement)
• Use the Platform for any unlawful purpose or in violation of these Terms

10. Third-Party Lending Partners

Your relationship with any Lending Partner that extends a loan offer is governed directly by that Lending Partner’s own terms, conditions, and loan agreement, which you must review and accept separately. Jindhan is not a party to that agreement and is not responsible for a Lending Partner’s decisions, conduct, disbursal, servicing, or collection practices.

11. Disclaimers

The Platform and any offers shown on it are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including as to accuracy, availability, or fitness for a particular purpose. We do not warrant that the Platform will be uninterrupted, error-free, or secure at all times.

12. Limitation of Liability

To the maximum extent permitted by law, Jindhan and its officers, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss arising from a Lending Partner’s decision, action, or omission, or from your reliance on any offer shown on the Platform. Our total liability arising from your use of the Platform shall not exceed nil, given the Platform is provided free of charge.

13. Indemnity

You agree to indemnify and hold Jindhan harmless from any claim, loss, or liability arising from your breach of these Terms, your misuse of the Platform, or information you (or a Referral Partner on your behalf) provide to us.

14. Suspension and Termination

We may suspend or terminate your access to the Platform, or decline to process an application, at our discretion, including where we suspect fraud, misuse, or a violation of these Terms.

15. Changes to These Terms

We may update these Terms from time to time. The updated Terms will be posted on this page with a revised “Last updated” date. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts at Bhopal, Madhya Pradesh.
